Terms and Conditions
These Terms govern services provided by Shipping Nibees LLC (United States) and Shipping Nibees Ltd (Ghana). By using our services, you agree to be bound by these Terms in full.
1. Introduction and Acceptance of Terms
These Terms and Conditions ("Terms") govern the use of services provided by Shipping Nibees LLC, a Tennessee limited liability company, and Shipping Nibees Ltd, a company organized under the laws of Ghana (collectively, "Shipping Nibees," "Company," "we," "our," or "us").
By creating an account, completing identity verification, receiving a shipping address, submitting shipments, utilizing our warehouse facilities, using our website, application, or services, or otherwise engaging with Shipping Nibees, you ("Customer," "you," or "your") acknowledge that you have read, understood, and agree to be bound by these Terms.
If you do not agree to these Terms, you must not use Shipping Nibees services.
These Terms are intended to supplement, and not replace, the Shipping Nibees Customer Handbook, Identity Verification & Customer Onboarding Policy, Privacy Policy, and any other applicable agreements or policies.
2. Eligibility and Account Requirements
To use Shipping Nibees services, you must:
- Be at least eighteen (18) years of age.
- Possess the legal capacity to enter into binding agreements.
- Provide accurate, complete, and current information during registration and throughout your use of our services.
- Successfully complete all required identity verification and onboarding procedures.
Customers are responsible for maintaining accurate account information and must promptly update any changes to their name, address, email address, telephone number, business information, or other relevant account information.
Shipping Nibees reserves the right to deny, suspend, restrict, or terminate access to services if eligibility requirements are not met.
3. Identity Verification and Account Approval
Access to Shipping Nibees services is subject to successful completion of identity verification and account approval procedures.
Customers may be required to provide:
- Government-issued identification
- Business registration documents
- Proof of address
- Purchase documentation
- Ownership documentation
- Tax identification information
- Additional documentation requested by Shipping Nibees
Completion of identity verification does not guarantee approval.
Shipping Nibees reserves the right to deny, suspend, restrict, revoke, or terminate access to services at its sole discretion.
Shipping Nibees may require re-verification of identity at any time if account ownership, shipment activity, payment activity, security concerns, compliance concerns, or other circumstances warrant additional review.
The Company reserves the right to conduct sanctions screening, restricted-party screening, fraud screening, and other due diligence reviews before or after account approval.
Customers acknowledge that Shipping Nibees may rely upon third-party verification providers and screening services in connection with identity verification and compliance reviews.
4. Services
Shipping Nibees provides logistics, freight forwarding, package receiving, package consolidation, export coordination, customs clearance coordination, transportation arrangement, and related services.
Services may include, but are not limited to:
- Air cargo transportation
- Sea cargo transportation
- Package receiving
- Warehouse processing
- Package consolidation
- Repackaging services
- Export coordination
- Customs clearance coordination
- Delivery coordination
- Commercial cargo handling
- Business shipping solutions
Shipping Nibees reserves the right to modify, suspend, limit, or discontinue any service at any time without prior notice.
Nothing in these Terms guarantees the availability of any particular service, shipping route, carrier, transit time, or destination.
5. Customer Responsibilities
Customers are responsible for:
- Providing accurate shipment information.
- Providing accurate package descriptions.
- Providing accurate shipment values.
- Providing invoices, receipts, and supporting documentation when requested.
- Ensuring all shipments comply with applicable laws and regulations.
- Ensuring all payment methods used are valid and authorized.
- Complying with all Shipping Nibees policies and procedures.
Customers shall not:
- Submit false or misleading information.
- Use another person's identity.
- Use Shipping Nibees services for unlawful purposes.
- Attempt to circumvent verification procedures.
- Submit prohibited, restricted, stolen, counterfeit, fraudulent, or unlawful items.
Customers acknowledge that inaccurate information may result in shipment delays, refusal of service, regulatory action, customs action, account suspension, account termination, or additional charges.
6. Ownership of Goods
Customers represent and warrant that:
- They are the lawful owner of all goods submitted to Shipping Nibees; or
- They possess full legal authority to ship, store, export, receive, transport, or otherwise handle such goods.
Customers further represent and warrant that all goods:
- Were lawfully acquired.
- Are not stolen.
- Are not counterfeit.
- Are not connected to unlawful activity.
- Do not violate any applicable law, regulation, court order, or governmental restriction.
Shipping Nibees reserves the right to request proof of ownership, proof of purchase, invoices, receipts, authorization letters, or other supporting documentation at any time.
Failure to provide satisfactory documentation may result in shipment refusal, shipment delay, account suspension, account termination, reporting to authorities, or other action deemed appropriate by Shipping Nibees.
7. Customer Purchase Authorization and Third-Party Retailers
Customers acknowledge and agree that Shipping Nibees LLC and Shipping Nibees Ltd are independent logistics and freight forwarding companies and are not affiliated with, endorsed by, sponsored by, or acting on behalf of any retailer, marketplace, manufacturer, supplier, or e-commerce platform.
Customers authorize Shipping Nibees to receive packages, merchandise, and shipments delivered to Shipping Nibees facilities on their behalf.
Customers remain solely responsible for:
- All purchases made through third-party retailers or suppliers.
- Compliance with retailer terms and conditions.
- Payment authorization and verification.
- Product selection and order accuracy.
- Product warranties.
- Returns and exchanges.
- Manufacturer restrictions.
- Retailer account compliance.
Shipping Nibees shall not be responsible for:
- Retailer order cancellations.
- Retailer fraud reviews.
- Payment disputes.
- Declined transactions.
- Product defects.
- Manufacturer defects.
- Missing items originating from retailers.
- Incorrect retailer shipments.
- Product performance issues.
- Warranty disputes.
- Marketplace account suspensions.
- Actions taken by retailers, suppliers, manufacturers, payment processors, or marketplaces.
Shipping Nibees reserves the right to request proof of purchase, invoices, payment confirmations, ownership documentation, authorization documentation, or additional supporting records before accepting, processing, storing, transporting, or exporting any shipment.
Shipping Nibees may refuse, delay, suspend, inspect, cancel, or otherwise restrict any shipment if ownership, payment authorization, export compliance, identity verification, shipment legitimacy, or required documentation cannot be reasonably verified.
Customers agree to indemnify and hold harmless Shipping Nibees LLC and Shipping Nibees Ltd from claims, disputes, investigations, losses, liabilities, penalties, damages, costs, and expenses arising from purchases made through third-party retailers, suppliers, manufacturers, marketplaces, or e-commerce platforms.
8. Payment, Fees, and Billing
Customers agree to pay all applicable charges, fees, shipping costs, storage fees, handling fees, customs-related charges, repackaging fees, and other amounts due for services provided by Shipping Nibees.
All charges must be paid in full before shipment release unless otherwise agreed to in writing by Shipping Nibees.
Shipping Nibees reserves the right to modify pricing, fees, rates, and charges at any time. The rates in effect at the time a shipment is processed shall apply.
Shipping Nibees is not responsible for errors, delays, failures, charge declines, or disputes involving third-party payment processors, financial institutions, payment gateways, or payment service providers.
Failure to make timely payment may result in shipment delays, storage fees, account restrictions, account suspension, or disposition of cargo as permitted by these Terms.
9. Package Receiving and Warehouse Operations
Shipping Nibees provides package receiving services for approved customers.
Receipt of a package by Shipping Nibees does not constitute inspection, verification, testing, authentication, quality control, or confirmation that the contents match the customer's order.
Package photographs, Proof of Delivery (POD), inventory records, or package processing activities are provided solely for operational purposes and do not constitute a quality inspection.
Shipping Nibees shall not be responsible for:
- Incorrect merchandise shipped by a retailer or supplier.
- Missing items originating from a retailer or supplier.
- Defective merchandise.
- Manufacturer defects.
- Damaged merchandise received from a retailer or carrier.
- Product performance issues.
- Warranty claims.
Shipping Nibees does not accept Cash on Delivery (COD) shipments.
Customers are responsible for coordinating delivery-related issues directly with retailers, suppliers, shippers, or carriers.
Warehouse access is strictly by appointment only. Shipping Nibees reserves the right to deny access to any person or vehicle at its sole discretion.
Only the verified account holder may receive package information, shipment information, invoices, account information, package photographs, or related records unless otherwise authorized by Shipping Nibees.
10. Storage Fees and Abandoned Cargo
Shipping Nibees is not a storage facility.
Customers are expected to arrange shipment of their goods within a reasonable time after receipt at a Shipping Nibees facility.
Storage shall be provided free of charge for the first five (5) working days following receipt of a package.
Beginning on the sixth (6th) working day, storage fees shall accrue at a rate of One Dollar (US $1.00) per kilogram per day, subject to any minimum storage charges established by Shipping Nibees.
Storage fees continue to accrue until all outstanding charges have been paid and the shipment has been processed, released, or otherwise removed from the facility.
Packages that remain unpaid, unclaimed, abandoned, or otherwise unresolved for more than four (4) weeks may be considered abandoned cargo.
Abandoned cargo may be donated, disposed of, auctioned, destroyed, sold, transferred, or otherwise handled at Shipping Nibees' sole discretion without compensation to the customer.
Shipping Nibees shall have no obligation to preserve, return, or compensate customers for abandoned cargo.
11. Shipping and Delivery
Shipping Nibees acts as a logistics provider, freight forwarder, transportation arranger, and shipment coordinator.
Shipping schedules, transit times, estimated delivery dates, carrier schedules, and shipment projections are estimates only and are not guaranteed.
Shipping Nibees does not guarantee:
- Delivery dates.
- Transit times.
- Carrier schedules.
- Customs processing times.
- Regulatory approval timelines.
- Delivery performance of third-party carriers.
Once a shipment has been tendered to a carrier, airline, shipping line, trucking company, customs authority, delivery provider, or other third party for transportation or processing, Shipping Nibees' responsibility for the shipment ends.
Shipping Nibees shall not be liable for loss, damage, delay, theft, seizure, customs action, carrier action, or other events occurring after the shipment leaves Shipping Nibees' custody and control.
12. Export Compliance
Customers are responsible for providing accurate shipment descriptions, declared values, invoices, receipts, proof of ownership, and any documentation required for export, transportation, customs clearance, or regulatory compliance.
Customers shall not knowingly provide false, misleading, incomplete, or inaccurate information regarding:
- Shipment contents.
- Shipment values.
- Ownership of goods.
- End users.
- Intended use of goods.
- Destination information.
Shipping Nibees reserves the right to refuse, delay, inspect, suspend, cancel, or otherwise restrict any shipment that may violate applicable laws, regulations, carrier requirements, governmental requirements, or company policies.
Customers remain responsible for compliance with all applicable export, import, transportation, customs, sanctions, trade, and regulatory requirements.
13. AES, EEI, USPPI, and Export Regulatory Disclaimer
Shipping Nibees does not provide legal advice regarding:
- USPPI determination.
- AES filing obligations.
- EEI filing requirements.
- Export licensing requirements.
- Export classification responsibilities.
- ECCN determinations.
- Foreign Trade Regulations (FTR) compliance.
- Export Administration Regulations (EAR) compliance.
Customers remain solely responsible for obtaining independent legal, regulatory, customs, export compliance, or trade compliance advice when necessary.
Nothing provided by Shipping Nibees shall be interpreted as legal advice or a legal determination regarding export obligations.
14. Restricted Commodities
Shipping Nibees reserves the right to refuse any shipment at its sole discretion.
Examples of prohibited or restricted items include:
- Firearms.
- Ammunition.
- Illegal drugs.
- Counterfeit goods.
- Stolen goods.
- Explosives.
- Hazardous materials.
- Export-controlled items requiring authorization.
- Undeclared lithium batteries.
- Goods prohibited by applicable law.
This list is not exhaustive.
Shipping Nibees reserves the right to determine whether any commodity may be accepted, transported, stored, processed, or exported.
15. Dangerous Goods and Lithium Batteries
Customers must accurately disclose all dangerous goods, hazardous materials, lithium batteries, and regulated commodities before shipment.
Certain dangerous goods may be accepted for transportation subject to:
- Applicable laws and regulations.
- Carrier requirements.
- Packaging requirements.
- Documentation requirements.
- Operational capabilities.
- Shipping Nibees approval.
Acceptance of any dangerous goods shipment is entirely at the discretion of Shipping Nibees.
Undeclared dangerous goods, hazardous materials, lithium batteries, or regulated commodities may result in shipment refusal, shipment destruction, regulatory reporting, account suspension, account termination, fines, penalties, or legal action.
Customers shall remain fully responsible for all consequences arising from inaccurate, incomplete, or misleading dangerous goods declarations.
16. Customs, Duties, Taxes, and Government Actions
Customers acknowledge that shipments may be subject to customs inspections, examinations, holds, duties, taxes, fees, permits, licensing requirements, or other governmental actions.
Shipping Nibees does not control and shall not be responsible for:
- Customs inspections.
- Customs examinations.
- Regulatory holds.
- Government seizures.
- Duties and taxes.
- Permit requirements.
- Regulatory approvals.
- Government enforcement actions.
- Customs clearance timelines.
Customers remain solely responsible for all duties, taxes, fines, penalties, assessments, storage charges, demurrage charges, government fees, and related costs arising from their shipments.
Shipping Nibees shall not be liable for losses, delays, damages, expenses, or other consequences resulting from customs actions, regulatory reviews, governmental actions, or law enforcement actions.
17. Fraud Prevention
Shipping Nibees maintains fraud prevention, identity verification, transaction monitoring, sanctions screening, and compliance review procedures designed to protect customers, transportation providers, business partners, and the Company.
Shipping Nibees reserves the right to investigate suspicious activity and may suspend, restrict, delay, cancel, refuse, inspect, or terminate services when fraud, misrepresentation, unauthorized activity, compliance concerns, or other irregularities are suspected.
Customers agree to cooperate fully with any fraud prevention or compliance review conducted by Shipping Nibees.
18. Cooperation with Law Enforcement
Shipping Nibees reserves the right to cooperate fully with law enforcement agencies, customs authorities, regulatory agencies, governmental authorities, transportation security authorities, and other authorized entities.
Such cooperation may include the disclosure of:
- Customer information.
- Shipment records.
- Transaction records.
- Communication records.
- Verification records.
- Documentation submitted by customers.
By using Shipping Nibees services, customers acknowledge and consent to such disclosures when required by law, requested by authorized authorities, or deemed necessary by Shipping Nibees to protect its legal interests, business operations, customers, transportation providers, or regulatory obligations.
19. International Operations
Shipping Nibees operates through Shipping Nibees LLC in the United States and Shipping Nibees Ltd in Ghana.
Customers acknowledge and agree that customer information, shipment information, account information, compliance records, verification records, and operational records may be shared between Shipping Nibees LLC and Shipping Nibees Ltd for operational, customer service, fraud prevention, compliance, transportation, customs, accounting, legal, and regulatory purposes.
Customers consent to such information sharing as a condition of using Shipping Nibees services.
20. Chargebacks and Payment Disputes
Customers agree not to initiate chargebacks, payment reversals, payment disputes, or similar actions for charges that are validly incurred under these Terms.
Customers must first contact Shipping Nibees and provide a reasonable opportunity to investigate and resolve any billing dispute.
If Shipping Nibees determines that a chargeback, payment reversal, or payment dispute was improper, fraudulent, abusive, or unsupported, Shipping Nibees may:
- Suspend or terminate customer accounts.
- Refuse future service.
- Recover unpaid balances.
- Recover collection costs.
- Recover attorneys' fees and legal expenses where permitted by law.
- Pursue any other remedies available under applicable law.
21. Insurance Disclaimer
Shipping Nibees does not provide cargo insurance unless expressly stated in writing.
Customers shipping high-value items are encouraged to obtain independent insurance coverage through a third-party insurance provider.
Once a shipment has been tendered to a carrier, airline, shipping line, trucking company, customs authority, delivery provider, or other third party for transportation or processing, Shipping Nibees shall not be responsible for loss, damage, theft, delay, mishandling, seizure, or other events occurring during transit.
Shipping Nibees shall not be liable for losses that would otherwise be covered by cargo insurance.
22. Limitation of Liability
To the fullest extent permitted by applicable law, Shipping Nibees LLC, Shipping Nibees Ltd, their owners, officers, directors, employees, contractors, agents, affiliates, representatives, successors, and assigns shall not be liable for any indirect, incidental, consequential, special, punitive, exemplary, or economic damages arising out of or relating to:
- Use of Shipping Nibees services.
- Shipment delays.
- Customs actions.
- Regulatory actions.
- Carrier actions.
- Government actions.
- Loss of business.
- Loss of profits.
- Loss of revenue.
- Loss of data.
- Loss of opportunity.
- Shipment loss or damage occurring outside Shipping Nibees' custody and control.
In no event shall Shipping Nibees' liability exceed the amount actually paid to Shipping Nibees for the specific service giving rise to the claim.
23. Indemnification
Customers agree to defend, indemnify, and hold harmless Shipping Nibees LLC, Shipping Nibees Ltd, their owners, officers, directors, employees, contractors, agents, affiliates, representatives, successors, and assigns from and against any claims, demands, liabilities, damages, judgments, losses, penalties, fines, costs, expenses, and attorneys' fees arising out of or relating to:
- Customer shipments.
- Customer conduct.
- Violations of these Terms.
- Regulatory violations.
- Customs violations.
- False declarations.
- Inaccurate information.
- Ownership disputes.
- Intellectual property disputes.
- Third-party claims relating to customer shipments.
24. Force Majeure
Shipping Nibees shall not be liable for delays, interruptions, failures, losses, or inability to perform services resulting from events beyond its reasonable control, including:
- Natural disasters.
- Severe weather.
- Floods.
- Fires.
- Epidemics.
- Pandemics.
- Labor disputes.
- Carrier disruptions.
- Government actions.
- Customs delays.
- Utility outages.
- Transportation disruptions.
- Security incidents.
- Acts of war.
- Civil unrest.
- Terrorism.
- Any other force majeure event.
25. Termination
Customers may terminate their accounts by contacting Shipping Nibees.
Shipping Nibees may suspend, restrict, deny, or terminate accounts or services at any time and for any lawful reason, including but not limited to:
- Fraud concerns.
- Compliance concerns.
- Non-payment.
- Violation of these Terms.
- Regulatory concerns.
- Business reasons.
Termination shall not relieve customers of obligations incurred prior to termination.
26. Dispute Resolution and Binding Arbitration
Any dispute, claim, controversy, or disagreement arising out of or relating to these Terms or the use of Shipping Nibees services shall be resolved exclusively through binding arbitration.
The arbitration shall be conducted in Tennessee in accordance with the rules of the American Arbitration Association (AAA) or another arbitration provider selected by Shipping Nibees.
The parties waive any right to a jury trial or participation in a class action, collective action, or representative action.
The arbitrator shall have exclusive authority to resolve disputes relating to the interpretation, applicability, enforceability, or formation of these Terms.
Nothing in this section shall prevent Shipping Nibees from seeking temporary injunctive relief or other equitable remedies in a court of competent jurisdiction when necessary to protect its rights or property.
27. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to conflict-of-law principles.
28. Changes to Terms
Shipping Nibees reserves the right to modify these Terms at any time.
Updated versions may be posted on the Shipping Nibees website, application, customer portal, or other communication channels.
Continued use of Shipping Nibees services following any modification constitutes acceptance of the revised Terms.

30. Customer Acknowledgment
By creating an account, completing identity verification, receiving a shipping address, submitting shipments, using Shipping Nibees facilities, utilizing Shipping Nibees services, or electronically accepting these Terms, the customer acknowledges that they have read, understood, and agree to be legally bound by these Terms and Conditions.
Electronic acceptance of these Terms shall have the same force and effect as a handwritten signature.
